Kim Zolciak and Kroy Biermann’s family often find themselves in trouble with the law. According to In Touch Weekly, their daughter Ariana Biermann, from “The Real Housewives of Atlanta,” has officially been charged with a DUI following her 2022 arrest.
In August 2022, the police pulled her over after she hit another car. At first, she was charged with driving under the influence, improper lane change, and underage alcohol possession. On Monday, it was reported that she now faces six charges related to the DUI incident.
These new charges include driving under the influence of multiple substances, driving under the influence of alcohol, possession of a drug-related object because she had a vape pen with a THC cartridge, and failure to obey traffic signs.
Ariana was arrested along with her boyfriend, Hudson McLeroy, who was a passenger in the car. According to the police report obtained by TMZ, Ariana claimed she hadn’t been drinking and said the smell of alcohol might be from her clothes.
She also mentioned that she had smoked a THC vape pen the night before the DUI arrest but hadn’t drunk alcohol before driving. However, the officers didn’t believe her. They said they could smell alcohol on her breath and noticed that she had a “noticeable sway” when they did a field sobriety test.
Ariana’s arrest comes at a time when her parents are struggling with financial problems and are preparing for their divorce trial. They have until August 26 to sell their mansion. Even though they have lowered the price, they haven’t found any buyers yet. With their financial problems growing, the family is hoping that they can avoid losing their home to foreclosure.
After her arrest, Ariana and her lawyer, Justin Spizman, fought back. In late 2023, Ariana filed a motion to exclude all the evidence gathered during what she calls an “unlawful seizure.” Spizman defended his client by saying, “Ariana was involved in a minor fender-bender.
When police arrived, the officer immediately started a DUI investigation. Even though Ariana kept saying she was just upset and anxious because of the minor accident, the officer wrongly decided she was under the influence of alcohol. That was not true. She completely denies these allegations and plans to fight these charges because she is not guilty.”
At the time of her arrest, Spizman also said that there were not enough facts to even suspect that Ariana was under the influence of alcohol or drugs, or involved in any criminal activity. He also maintains that Ariana did not commit “any traffic violations” before she was stopped.
He added, “This initial detention was an illegal seizure without a warrant, not supported by probable cause or reasonable suspicion, violating Ariana’s rights under the Fourth Amendment to the U.S. Constitution.” He also asked the court to dismiss the results of Ariana’s alleged refusal to take a chemical test related to the charges.
This report is just the latest in a series of legal issues for the Zolciak-Biermann family. Last month, Ariana’s sister Brielle Biermann, who reportedly owed $84,000 in unpaid car payments, was sued for a car crash that she claims she wasn’t involved in.
Weeks before this lawsuit, their father was cited because their dog was disturbing the neighbors. Their mother, Kim Zolciak, was also ordered to pay court and credit card fees, and there’s no report saying she paid them. The Zolciak-Biermanns continue to face legal troubles, and fans can only hope they can find a way out of these problems.
