Nintendo Fined €35 Million Over Switch Joy-Con Drift Case in France

Nintendo is facing renewed scrutiny in Europe after agreeing to pay a €35 million fine linked to the long-running Joy-Con drift controversy. French regulators concluded that Nintendo of Europe did not adequately inform consumers about known defects in its original Switch controllers, raising concerns about transparency and consumer protection.

According to France’s General Directorate for Competition, Consumer Affairs and Fraud Control, or DGCCRF, the company accepted a financial penalty following an investigation into “deceptive commercial practices.” The probe found that Nintendo was aware of technical issues affecting Joy-Con controllers as early as 2018 but only communicated publicly about them in 2020.

What the Investigation Found

The regulator’s findings center on the widely reported “Joy-Con drift” issue, which causes controllers to register unintended movements even when untouched. This defect can lead to erratic gameplay, including phantom inputs or unresponsive controls, significantly affecting user experience.

Authorities determined that Nintendo’s delayed communication played a key role in consumer decisions. The DGCCRF stated that the company’s limited and late disclosures may have discouraged customers from seeking repairs through official channels. Instead, some users reportedly purchased replacement controllers, believing their devices were beyond repair.

The investigation began after a complaint filed in 2020 by the consumer advocacy group UFC-Que Choisir. The organization had previously warned about potential “planned obsolescence,” arguing that known issues were not adequately resolved despite internal awareness of the defect. Regulators ultimately concluded that Nintendo’s handling of the situation altered consumer behavior in a way that met the legal definition of deceptive practice.

Nintendo’s Response to the Fine

Nintendo of Europe has responded by emphasizing that the settlement does not represent an admission of wrongdoing. In a statement, the company said it did not “intentionally mislead consumers” and described the agreement as an effort to resolve the matter amicably.

While the company disputes the intent behind its actions, it has taken steps in recent years to address the issue. As part of a broader European initiative, Nintendo committed in 2023 to offering free repairs for affected Joy-Con controllers, even beyond the standard warranty period. This move was aimed at restoring consumer trust and reducing the need for replacements.

The Joy-Con drift problem has been a persistent challenge for Nintendo since the launch of the Nintendo Switch in 2017. Reports of controller issues surfaced globally, leading to multiple legal and regulatory actions across different markets.

In the United States, a class-action lawsuit was filed in 2019, though it was ultimately dismissed in 2024. Meanwhile, consumer watchdogs in other regions have also highlighted the scale of the issue. In the UK, for example, the organization Which? reported that more than 40% of original Switch Joy-Con controllers experienced drift-related problems.

These findings have contributed to ongoing debates about product durability and accountability in the gaming industry. The concept of planned obsolescence, where products are designed with limited lifespans, has been a particular point of contention, though companies often deny such practices.
