A New South Wales court issued a warrant for his arrest after finding him guilty of assault occasioning actual bodily harm, intentionally choking a person without consent, and common assault.
Gallagher was initially arrested in December 2025 following a reported domestic violence incident in Sydney. He was subsequently released on bail, but court proceedings continued while he was outside Australia. According to USA TODAY, a representative for New South Wales Courts confirmed his conviction on September 1, 2026.

Burwood judge Janine Lacy reportedly cited the seriousness of the offenses and Gallagher’s absence from court when issuing the arrest warrant. Rolling Stone, which reported on the ruling, said the court found the offenses proven after Gallagher had denied choking or covering his former partner’s mouth.
Court documents referenced by Rolling Stone describe an encounter involving Gallagher and his former Below Deck castmate Gael Cameron. The pair previously had a relationship and share a young son, while Cameron is also named in an Apprehended Violence Application involving Gallagher. The criminal case and the application were scheduled for the same September 1 hearing.
The case follows Gallagher’s earlier statement to Rolling Stone in August, in which he disputed the public portrayal of the incident. He said, “I don’t believe the public has heard the full story surrounding what happened,” and argued that publicly reported information represented only one side of what he described as an extremely complicated situation.
Gallagher also claimed he possessed video footage, messages and other records that he believed could provide additional context. However, Rolling Stone reported that he did not provide the publication with the materials he said could offer a different perspective.
The arrest warrant now adds another development to Gallagher’s ongoing legal troubles. According to Rolling Stone, police have been ordered to arrest him and bring him before the court.
